Please read these Terms of Service carefully before using the QA Proof platform. By creating an account or using our services, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using QA Proof ("the Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, do not access or use the Service.

2. Description of Service

QA Proof is an AI-powered design QA platform that helps teams detect visual regressions and inconsistencies in web applications. The Service includes:

  • Automated visual comparison and regression testing
  • Browser plugin for capturing screenshots and annotations
  • API access for integrating QA tests into CI/CD pipelines
  • Team collaboration and project management tools
  • Integrations with third-party tools (Figma, GitHub, GitLab, Jira, Slack)

3. Account Registration

3.1 Eligibility

You must be at least 16 years old to use the Service. By creating an account, you confirm that you meet this requirement.

3.2 Account Security

  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately at security@qaproof.io if you suspect unauthorized access
  • You may not share your account or API keys with unauthorized third parties

3.3 Account Information

You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

4. Subscriptions and Payment

4.1 Plans

QA Proof offers Free, Pro, and Enterprise plans. Features and limits vary by plan as described on our Pricing page.

4.2 Billing

  • Paid subscriptions are billed in advance on a monthly or annual basis
  • All fees are exclusive of applicable taxes, which will be added where required by law
  • Payment is processed securely through Paddle, our billing provider
  • You authorize us to charge your payment method for all amounts due

4.3 Cancellation and Refunds

  • You may cancel your subscription at any time from your account settings
  • Cancellation takes effect at the end of the current billing period — you retain access until then
  • We do not provide refunds for partial billing periods, except where required by applicable law
  • Annual plan refunds may be considered within 14 days of initial purchase — contact support@qaproof.io

4.4 Plan Changes

Upgrades take effect immediately; downgrades take effect at the start of the next billing period. Unused capacity from upgrades is not refunded as credit.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Test or scan websites or applications you do not own or have explicit permission to test
  • Circumvent, disable, or interfere with security-related features of the Service
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Upload or transmit malware, viruses, or any malicious code
  • Scrape, crawl, or extract data from the Service without our written permission
  • Resell or sublicense access to the Service without authorization
  • Use the Service in a manner that exceeds your plan's usage limits or places unreasonable load on our infrastructure

We reserve the right to suspend or terminate accounts that violate these restrictions without prior notice.

6. Intellectual Property

6.1 Our IP

The Service, including its software, design, trademarks, and content, is owned by QA Proof and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited right to use the Service as described herein.

6.2 Your Content

You retain ownership of all data, screenshots, configurations, and other content you submit to the Service ("Your Content"). By using the Service, you grant QA Proof a limited, non-exclusive license to store, process, and display Your Content solely as necessary to provide the Service to you.

6.3 Feedback

If you submit suggestions, ideas, or feedback about the Service, you grant QA Proof the right to use such feedback without restriction or compensation.

7. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described therein.

8. Third-Party Integrations

The Service may integrate with third-party platforms (Figma, GitHub, GitLab, Jira, Slack, etc.). Your use of those integrations is also governed by the respective third party's terms and privacy policies. QA Proof is not responsible for the availability or behavior of third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not guarantee that visual comparison results will be 100% accurate or complete.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QA PROOF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO QA PROOF IN THE ONE (1) MONTH PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold QA Proof harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) Your Content; or (c) your violation of any third-party rights.

12. Service Availability and Modifications

  • We strive for high availability but do not guarantee uninterrupted access to the Service
  • We may perform scheduled maintenance with advance notice where reasonably practicable
  • We reserve the right to modify, suspend, or discontinue any part of the Service with at least 14 days' notice
  • We may update these Terms at any time — material changes will be communicated via email or in-app notification

13. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your account immediately if you breach these Terms. Upon termination:

  • Your right to access the Service ceases immediately
  • Your data will be retained for 90 days to allow export, then permanently deleted
  • All provisions that by their nature should survive termination (including IP rights, disclaimers, and limitations of liability) remain in effect

14. Force Majeure

Neither party shall be held liable for any delay or failure to perform its obligations under these Terms where such failure results from circumstances beyond that party's reasonable control, including but not limited to: acts of God, natural disasters, floods, fires, earthquakes, wars, armed conflicts, government actions, strikes, pandemics, interruptions to internet or telecommunications services, or failures of third-party infrastructure.

In such cases, performance of the affected obligations shall be suspended for the duration of the force majeure event. If the event continues for more than three (3) months, either party may terminate the agreement without liability by providing written notice to the other party.

15. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

16. Cookies

We use cookies and similar tracking technologies to operate and improve the Service. By using the Service, you consent to our use of cookies in accordance with our Cookie Policy. You may manage or disable cookies through your browser settings, though this may affect certain features of the Service.

17. Dispute Resolution

In the event of any dispute arising out of or in connection with these Terms or the Service, we encourage you to contact us first at support@qaproof.io so that we can attempt to resolve the matter amicably.

We will make reasonable efforts to respond within 14 days and to resolve the dispute within 30 days of receiving your complaint. Only if no amicable resolution is reached within that period should formal proceedings be initiated.

Consumer customers residing in the EU may also use the EU online dispute resolution platform: ec.europa.eu/consumers/odr

18. Governing Law

These Terms are governed by and construed in accordance with the laws of Ukraine.

18.1 Business Customers (B2B)

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Ukraine.

18.2 Consumer Customers residing in the EU (B2C)

Nothing in these Terms limits your rights under the mandatory consumer protection laws of your country of residence. You may also submit a dispute to the EU online dispute resolution platform: ec.europa.eu/consumers/odr

18.3 Consumer Customers outside the EU (B2C)

Disputes shall be resolved under Ukrainian law. We will make reasonable efforts to resolve any issues amicably before pursuing formal proceedings.

19. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page
  • Notify you via email or an in-app notification at least 14 days before changes take effect
  • Where required by law, obtain your consent

Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
